Terms of Use

Mersm AI (“Mersm”, “we”, “us”) is a visual workspace that helps online sellers create product images, listings and marketing content with AI. These terms apply to the Mersm AI app at app.mersm.dev and to any account you create there.

By creating an account or using the app, you agree to these terms and to our Privacy Policy. If you use Mersm AI for a business, you confirm that you can accept these terms on its behalf.

The app is still being built. Features may change, appear or be removed, and some things may not work as expected.

• The beta is free for six months from when your account is created, with no card and no deposit.
• Usage is generous but limited. The app shows each limit before you reach it, and reaching a limit never deletes your work.
• We’ll tell you in advance, by email and in the app, before the free beta ends or paid plans start. Nothing is charged without your agreement.
• We don’t promise any level of availability during the beta, and we may pause the service for maintenance.

You must be at least 18 and give accurate details. Keep your password safe: you’re responsible for what happens under your account.

If you think someone else has access to your account, tell us straight away at contact@mersm.dev.

If you own a workspace, you’re responsible for the people you invite to it and for what they do there.

You keep all rights to what you upload or create in Mersm AI: product photos, logos, text, brand details and the results you generate (“your content”).

You allow us to store, process and display your content only to run the service for you, for example to generate the images and listings you ask for, and to keep backups. We don’t sell your content, and we don’t use it to advertise.

You confirm that you have the right to use everything you upload, including logos, trademarks, photos of people and product claims.

Results are produced by AI models. They can be wrong or incomplete, and they can resemble results that others receive. Check every result before you publish it, especially product facts such as sizes, materials, ingredients, prices, certifications and claims.

You’re responsible for the listings and creatives you publish, and for following the rules of the marketplaces and platforms you sell on.

To produce results, the content each request needs is sent to the AI model providers we use. The Privacy Policy explains how we handle that.

Don’t use Mersm AI to:

• break any law, including consumer protection, advertising and e-commerce rules;
• infringe copyright, trademarks or other rights, or use logos and brands you aren’t allowed to use;
• make misleading product claims or fake reviews, or pretend to be another seller or brand;
• create sexual, hateful, violent or otherwise harmful content, or any content involving minors in an inappropriate way;
• upload malware, probe or overload our systems, scrape the app, or get around usage limits or security;
• resell or share access to the service without our written agreement.

We may review, block or remove content and results that break these rules, and our safety checks may stop some requests.

To help you, to investigate a problem or to keep the service safe, authorised Mersm staff can view your workspace. Staff accounts use two-step verification, and every staff action is recorded in an audit log.

Mersm AI, its software, design and brand belong to Mersm. These terms don’t give you any rights to them beyond using the app as intended. If you send us feedback or ideas, we may use them freely.

You can sign in with Google, and Mersm AI works alongside other services such as email providers and online marketplaces. Their own terms apply when you use them, and we aren’t responsible for them.

You can stop using Mersm AI at any time, and you can ask us to delete your account by writing to contact@mersm.dev. The Privacy Policy explains what happens to your data.

We may suspend or close an account that breaks these terms or puts other users or the service at risk. Unless the law or safety requires otherwise, we’ll tell you why and give you a chance to download your content first.

During the beta, Mersm AI is provided “as is” and “as available”. As far as the law allows, we don’t promise that it will be uninterrupted, free of errors or suitable for a particular purpose.

As far as the law allows, Mersm isn’t liable for indirect or consequential losses, such as lost sales, profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or SAR 100 if you paid nothing.

Nothing in these terms limits rights that the law doesn’t allow us to limit.

We may update these terms as Mersm AI grows. We’ll post the new version here with a new date and, if a change matters, tell you by email or in the app before it takes effect. If you keep using the app after that, the new terms apply.

These terms are governed by the laws of the Kingdom of Saudi Arabia, and its competent courts settle any dispute about them.

These terms are published in Arabic and English. If the two versions differ, the Arabic version prevails.
